These Terms & Conditions (the “Terms”) govern your access to and use of the website at https://eastcoastsprayers.com (the “Site”) and any lawn care, pest control, or related services (the “Services”) provided by 561 Pest LLC d/b/a East Coast Sprayers (“Company,” “we,” “us,” or “our”). By using the Site or engaging us for Services, you agree to these Terms. If you do not agree, do not use the Site or the Services.
1. Services
We provide professional lawn care, fertilization, weed control, pest control, tree and shrub care, and related services in Palm Beach County, Florida. Specific scope, frequency, pricing, and service area for any given customer engagement will be set out in a written service plan or quote (the “Service Plan”), which is incorporated into these Terms by reference.
2. Quotes & Pricing
All quotes are based on the property condition observed during the on-site evaluation. Pricing may change if the scope of work, property size, pest pressure, or service frequency materially changes. Any pricing change will be communicated in writing before it takes effect.
3. Scheduling & Access
You agree to provide reasonable access to the property on scheduled service dates, including unlocked gates, restrained pets, and clear access to treatment areas. If we cannot complete a scheduled service due to lack of access, we may charge a trip fee equal to a fraction of the regular service cost.
4. Payment Terms
Invoices are due upon receipt unless otherwise stated in the Service Plan. Past-due balances may accrue a late fee of the lesser of 1.5% per month or the maximum rate permitted by Florida law. We reserve the right to suspend Services on accounts that are more than thirty (30) days past due.
5. Residential Cancellation
Residential customers are not bound by long-term contracts. You may cancel ongoing Services at any time by notifying us by phone at (561) 203-5555 or by email at hello@eastcoastsprayers.com. Cancellations apply to future services; we do not refund services already rendered, except as expressly provided in the Greener-Grass Guarantee below.
6. Commercial Engagements
Commercial customers (HOAs, property managers, retail and office parks, municipalities) may be subject to additional contractual terms negotiated in the Service Plan, including but not limited to term length, renewal, insurance, and indemnification provisions. Where the commercial Service Plan and these Terms conflict, the Service Plan controls.
7. Greener-Grass Guarantee
For residential turf-fertilization programs that we manage end-to-end (i.e., we control the schedule, products, and application), we offer the following guarantee:
- If, after ninety (90) days of consistent service, the treated turf is not visibly greener and healthier than the baseline condition documented at our initial evaluation, we will (at our option) either continue treatment at no additional cost until measurable improvement is achieved, or refund fees paid for the turf-fertilization program during that period.
The guarantee does not cover lawns where the customer has declined recommended treatments, has not provided adequate irrigation, has refused soil amendments or pH adjustments we have recommended, has retained a separate provider for overlapping services, or where the lawn condition is the result of construction damage, pet damage, prolonged drought stress, or other causes outside our reasonable control.
8. Pesticides, Fertilizers & Safety
We apply only EPA-registered and Florida-approved products in accordance with label directions and applicable law. All applicators are licensed by the Florida Department of Agriculture and Consumer Services. We provide pre-service notification before each scheduled visit. Customers and any residents, employees, or visitors should observe label re-entry intervals posted at the property.
9. Limitation of Liability
To the maximum extent permitted by law, the Company’s total liability for any claim arising out of or related to the Services or these Terms shall not exceed the total amount paid by the customer to the Company for the specific Service that gave rise to the claim during the twelve (12) months immediately preceding the event. In no event shall the Company be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or lost business opportunity.
10. Warranties
Except for the express Greener-Grass Guarantee in Section 7, the Services are provided on an “as-is” basis. To the maximum extent permitted by law, the Company disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
11. Intellectual Property
The Site, including all text, photography, logos, and brand elements, is owned by 561 Pest LLC d/b/a East Coast Sprayers or its licensors and is protected by U.S. copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works without prior written permission.
12. Photography & Marketing
We may photograph treated properties for the purpose of documenting Service results. Identifying details (street numbers, license plates) will not be published. If you do not want photos of your property used in marketing materials, notify us in writing at hello@eastcoastsprayers.com and we will honor the request.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and the parties consent to the jurisdiction and venue of those courts.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with the “Last updated” date above. Continued use of the Site or the Services after an update constitutes acceptance of the revised Terms.
